Connected Hair Forum Rules

§1. General Provisions
1. These Terms of Use set forth the rules for using the discussion forum available at `connectedhair.com/forum` (hereinafter: the Forum), which is part of the Connected Hair website.
2. The operator of the Forum and the administrator of Users’ personal data is CHA Spółka z ograniczoną odpowiedzialnością, with its registered office in Gdynia, at ul. Przebendowskich 26/3, 81-526 Gdynia, Tax ID No . 5862414133, REGON 540865874, entered in the National Court Register (KRS) under number 0001154587, contact email: hello@connectedhair.com (hereinafter: Administrator).
3. The Forum serves as a platform for the exchange of knowledge, experiences, and inspiration among professionals in the fields of hairdressing, barbering, hair coloring, and trichology, including Users with access to the Connected Hair Academy.
4. Use of the Forum is voluntary and free of charge for registered users of connectedhair.com. The administrator may, in the future, restrict access to certain sections to users with active PRO accounts only.
5. Definitions:
– A User is a natural person who has an account on connectedhair.com and has accepted these Terms and Conditions.
– "Content " refers to any statement, post, comment, image, link, audio file, video, or other data published by a User on the Forum.
– A moderator is a person appointed by the Administrator to oversee the forum.
§2. Terms and Conditions of Participation
1. The Forum may be used by adults with full legal capacity who:
a. registers an account on connectedhair.com,
b. agrees to the Terms of Service and Privacy Policy,
c. provide accurate information during registration.
2. A forum account is personal. Users may not share their access with third parties.
3. The Administrator may verify whether the User works in the hairdressing industry (e.g., through a social media profile, salon website, or photo from the workplace). Failure to verify does not block access to publicly available sections.
§3. Rules for publishing content
1. The User publishes Content on their own behalf and bears full responsibility for it.
2. Content posted on the Forum must comply with the law, be in good taste, and be relevant to the Forum’s subject matter.
3. It is prohibited to post Content that:
a. are unlawful, in particular infringe upon the copyrights, image rights, personal rights, or trade secrets of others,
b. contain profanity, hate speech, or content that is discriminatory, offensive, intimidating, or degrading,
c. contain pornographic, graphic, or harmful content for minors,
d. violate the privacy of others (publishing personal information, contact details, or photos of third parties without their consent),
e. constitute spam, unsolicited commercial messages, or chain letters,
f. contain links to malicious, phishing, or illegal websites,
g. promote the activities of competing hairdressing schools, courses, or educational platforms in an intrusive manner or without the Administrator’s prior consent,
h. incite the commission of a crime, self-harm, or bodily harm (e.g., dangerous chemical procedures performed without proper qualifications),
i. contain false information, particularly regarding the health effects of hairdressing and trichological treatments.
4. We recommend posting photos of your work along with a description of the technique used, the products used, and a brief case study. You must obtain the client’s consent before posting their photo.
5. Quoting excerpts from Connected Hair courses for discussion purposes is permitted under fair use provisions (Section 29 of the Copyright and Related Rights Act). Publishing full recordings, transcripts, or PDF materials from the Academy outside the Forum is prohibited and constitutes a violation of the access license.
6. Advertisements for your own services, salons, stores, or courses are permitted only in the designated section of the Forum and within the scope specified by the Administrator.
§4. Copyright and License for the Content
1. The user retains the economic rights to the Content they publish.
2. By posting Content on the Forum, the User grants the Administrator a royalty-free, non-exclusive, worldwide license to use such Content to the extent necessary to operate the Forum and promote Connected Hair, in the following fields of exploitation:
a. digital recording and reproduction,
b. making them publicly available in such a way that anyone can access them at a time and place of their choosing (the Internet),
c. Citing and sharing on Connected Hair’s social media, in its newsletter, and in marketing materials, while crediting the User.
3. The license is granted for the duration of these Terms and Conditions and remains in effect with respect to Content published during that period, even after the User has ceased using the Forum.
4. The User represents that the published Content is the result of his or her own creative work or that he or she holds the appropriate rights to it, and that the publication does not infringe upon the rights of third parties.
5. The Administrator does not acquire copyright to the Content, and the User may delete their post at any time (subject to §5(4)).
§5. Moderation and Sanctions
1. The Administrator reserves the right to have the Forum moderated by designated Moderators.
2. The administrator may, without prior notice:
a. hide or remove Content that violates the Terms of Service,
b. block the User's ability to add new Content (temporarily or permanently),
c. delete the account of a User who grossly or repeatedly violates the Terms of Service,
d. disclose the User’s data to law enforcement authorities if required by law or in response to a legitimate request from a government agency.
3. Any User may report Content that violates the Terms of Service by clicking the “Report” button next to the post or by emailing hello@connectedhair.com. The report should include the post’s URL and a brief explanation.
4. The Administrator may retain a copy of the deleted Content for evidentiary purposes for the period necessary to address any potential complaints, legal proceedings, or administrative proceedings.
5. The Moderator’s decision to remove Content or suspend an account is subject to the appeal procedure described in §8.
§6. Liability
1. The administrator makes every effort to ensure that the Forum operates without interruption, but does not guarantee 100% availability and reserves the right to perform technical maintenance.
2. The Administrator shall not be liable for Content published by Users, subject to the provisions of Articles 14–15 of the Act on the Provision of Electronic Services and EU legislation on online intermediation (DSA).
3. The advice posted by Users is intended as a sharing of experiences and does not replace professional consultation. Performing chemical, coloring, and trichological treatments requires appropriate qualifications and must be tailored to the client’s specific condition in each case. The Administrator is not liable for any damages resulting from the application of advice posted by other Users.
§7. Personal Data
1. The entity specified in §1(2) is the controller of the personal data of Forum Users.
2. Personal data is processed in accordance with the GDPR and the Privacy Policy available at `connectedhair.com/privacy-policy`.
3. The basis for processing is:
a. performance of a contract for the provision of electronic services (Article 6(1)(b) of the GDPR),
b. the Controller’s legitimate interest in ensuring the security of the Forum, moderating it, and pursuing legal claims (Article 6(1)(f) of the GDPR),
c. the User’s consent regarding the publication of Content containing personal data.
4. Data is retained for the duration of the account and for the period during which claims may be brought. Deleted content may be retained in backups for up to 90 days.
5. The user has the right to access, rectify, erase, restrict the processing of, and transfer their data, as well as the right to object and to lodge a complaint with the President of the Personal Data Protection Office.
§8. Complaints
1. Complaints regarding the operation of the Forum and moderation decisions may be submitted:
a. by email to hello@connectedhair.com,
b. by mail to the Administrator’s registered office address specified in §1(2).
2. The complaint should include: first and last name (or username), email address, a description of the problem, and the User’s request.
3. The administrator will review the complaint within 14 days of receiving it. Failure to respond within this period shall be deemed an acceptance of the complaint.
4. Consumers have the right to use alternative dispute resolution (ADR) mechanisms, including the European Commission’s ODR platform (`ec.europa.eu/consumers/odr`).
§9. Technical Requirements
To use the Forum, you must:
1. a device with Internet access,
2. the latest version of one of the popular web browsers (Chrome, Safari, Firefox, Edge),
3. an active email account,
4. Managing cookies and JavaScript in your browser.
§10. Amendments to the Rules and Regulations
1. The Administrator may amend these Terms and Conditions for good cause, in particular:
a. changes in the law,
b. introducing new features to the Forum,
c. the need to clarify the provisions or remove ambiguities.
2. Users will be notified of changes to the Terms of Service via email and a post on the Forum at least 14 days in advance.
3. Users who do not accept the changes may terminate their use of the Forum within 14 days of the date of notification by deleting their account or sending a request to hello@connectedhair.com.
§11. Final Provisions
1. In matters not covered by these Terms and Conditions, the provisions of Polish law shall apply, in particular the Civil Code, the Act on the Provision of Electronic Services, the Act on Copyright and Related Rights, and the GDPR.
2. Any disputes arising from the use of the Forum shall be settled by the common court with jurisdiction over the Administrator’s registered office, subject to mandatory provisions regarding court jurisdiction in cases involving consumers.
3. If any provision of these Terms and Conditions is found to be invalid, the remaining provisions shall remain in full force and effect.
4. The current version of the Terms and Conditions is available at `connectedhair.com/forum-terms-and-conditions` in a format that allows you to download and print it.
